From the moment of enactment of this Law till 1st January 2016 subparagraph 8-1) of Article 7 is effective in the new edition, and from 1st January 2016 until 1st January 2017 subparagraph 8-1) of Article 7 is effective in the new edition;

CHAPTER 1. GENERAL PROVISIONS
Article 1. The Fundamental Definitions Used in this Law

The following fundamental definitions have been used in this Law:
1) emergency reservation – the minimum use of electric power (minimum consumer capacity) by facilities of the consumer with the fully stopped technological process, which use supports their condition that is safe for the life, health of people and for the environment, and also the functioning of current receivers for standby and security light, security and fire alarm systems, fire fighting pumps, water outlets, cooling of main technological equipment, communication and emergency ventilation;
2) emergency malfunction shall mean inadmissible deviations of technological parameters of operation of electrical installations or its elements which caused their removal from service or destruction during operation;
2-1) readiness passport – a yearly issued document confirming the readiness of power producing and power transmitting organizations to operate during the autumn-winter period;
2-2) common purchaser – a legal entity determined by the authorized body that carries out centralized purchases of the service for maintenance of electric capacity readiness and centralized rendering of the service for ensuring electric capacity readiness to bear loads through the procedure stipulated by this Law;
2-3) generating plant – a unit generating electric power;
2-4) dispatcher technological control – the process that is performed by the dispatcher and designated to solve tasks of control and operation of functioning modes of electric power grids by means of automated systems of dispatcher and technological control, and also reception and processing of messages from natural persons and legal entities about prerequisites of occurrence or about the occurrence of technological failures that require undertaking measures of response and removing malfunctions and damages;
3), 4) repealed by 18;
5) system incident shall mean emergency malfunction of the regimes of operation of electric power industry objects which leads to the loss of stability of the unified electric power system of the Republic of Kazakhstan, and to its division to parts;
6) system services shall mean the services rendered by the system operator to entities of the wholesale market of electric power for the transmission of electric energy, technical dispatching control, regulation and reservation of power, organization of balancing of the generation-consumption of electric energy;
7) system operator * a national company which carries out centralised operative-dispatching control, providing for parallel operation with energy systems of other countries, maintenance of balance in the energy system, rendering of system services and acquisition of ancillary services from entities of the wholesale market of electric energy, and also transmission of electric energy via the national power grid, its technical maintenance and keeping in the operational readiness;
8) protection zone of heating networks shall mean land plots allocated for the purpose of ensuring the safety of heating networks, creation of the normal operating conditions, prevention of their damage, and also accidents among the population that happened to be present in the protection zone of those networks;
8-1) heat supply system – a complex consisting of heat producing, head transmitting and heat using plants;
9) thermal power transmission – a service for transportation of thermal power and (or) heat carrier by thermal power grids that is rendered by power transmitting organizations in accordance with made contracts;
10) retail market of thermal power – a system of mutual relations of participants in the production, transmission of thermal power to perform heat supplies to consumers on the basis of contracts;
11) investment program shall mean a program aimed at the creation of new assets, expansion, renovation, reconstruction and technical re-equipping of the existing assets;
12) repealed by 18;
13) investment agreement – an agreement on the fulfillment of an investment program between the power producing organization, the authorized body and the state body performing administration in the spheres of natural monopolies;

15) device of commercial recording shall mean a technical installation designed for commercial recording of electric power, electric or thermal energy, allowed for the application in accordance with the procedure as established by the legislation of the Republic of Kazakhstan;

15-2) autumn-winter period – a heating season, whose commencement and completion are established by local executive bodies;
16) unified electric power grid of the Republic of Kazakhstan shall mean an aggregate of electric stations, power transmission lines, and substations which provide for reliable and qualitative energy supply of consumers of the Republic of Kazakhstan;
17) reserve of electric power of the unified electric power grid of the Republic of Kazakhstan shall mean electric power of aggregates of energy producing organizations which have the required structure, amount, and also the degree of preparedness to dispatching, complying with the requirements as provided for by the contract;
18) ancillary services shall mean services acquired by the system operator from entities of the wholesale market of electric energy for ensuring the readiness of the required volumes and structure of operative reserves of electric power, regulation of active and reactive powers, on starting the energy system from the deenergized state;
18-1) state technical inspector * an official person of the authorised body which carries out state control over the compliance with requirements of the legislation of the Republic of Kazakhstan concerning electric power industry;
18-2) market council – a non-commercial organization carrying out activity for monitoring of the functioning of the electric power and capacity market, and also other functions stipulated by this Law;
19) operation day shall mean a current day during which the system operator conducts the operations on the centralized operative and dispatching control of the implementation of the contracts for the purchase-and-sale of electric energy executed by entities of the wholesale market of electric energy;
20) centralized operative-dispatching control shall mean a process of continuous control of technically coordinated operation of energy generating, energy transmitting, energy supplying organizations and consumers of electric energy, which is carried out by the system operator, and which provides for a specified level of reliability of the unified electric power grid of the Republic of Kazakhstan, and compliance with the standard quality of electric energy;
20-1) operator of the market of centralised trading * an organisation which carries out centralised trading in electric energy, including spot trades in electric energy, and services for maintenance of electric capacity readiness;
21) inter-regional and/or interstate power transmission lines shall mean power transmission lines with voltage of 220 kV and more, which provide for the transmission of electric power between regions and/or states;
22) regional electric power grid company – a power transmitting organization that has a direct technological connection with a power producing organization and (or) with the national electric power grids, that possesses cable or overhead electric power transmission lines of not less than four voltage classes (220, 110, 35, 20, 10 (6), 0,4 kilovolts), that operates electric power grids of the regional level and that has no less than 10 000 connected consumers;
22-1) fuel operational reserve standard * the minimum fuel operational reserve of energy producing organisations in daily quantities;
22-2) expert organization – a legal entity carrying out activity for conducting power expert examination in accordance with the legislation of the Republic of Kazakhstan;
23) balancing electric energy shall mean electric energy used for elimination of arising disbalances in the implementation of the hourly daily schedule of production-consumption of electric energy approved by the system operator;
23-1) limiting tariff for balancing electric power – the maximum value of a supply tariff (price) of electric power to be sold in the balancing electric power market that is approved by the authorized body for groups of power producing organizations selling electric power for a period equal to seven years, that takes into account costs of electric power production, purchase of electric power from the settlement-financial centre for promotion of renewable energy sources and fixed profit for balancing, that is determined according to technique established by the authorized body;
24) technical dispatching shall mean a service rendered by the system operator for the performance of the centralized operative-dispatching control of the regimes of production and consumption of electric energy in the unified electric power grid of the Republic of Kazakhstan;
24-1) technological reservation – the minimum use of electric power (minimum consumer capacity) and the duration of time that are required to complete a continuous technological process and to prevent a risk for lives of people and for the environment;
24-2) authorized body in the sphere of housing relations and housing-and-communal economy – the central executive body that carries out the administration and inter-sector coordination in the sphere of heat supply (except for heat-and-power plants and boiler houses that produce heat in a centralized heat supply zone) within the limits of inhabited areas;
24-3) organization for modernization and development of housing-communal economy – a joint-stock company with one hundred percent participation of the state, whose activity is aimed at the modernization and development of housing-communal economy;
24-4) home consumer – a natural person that uses electric power for own home needs not relating to the production (sale) of goods, work and rendering of services;
24-5) household consumer - a natural person who uses electric power for own household needs not related to the production (sale) of goods, works and rendering of services;
25) consumer shall mean a natural or legal person which consumes electric and/or thermal energy on the basis of a contract;
26) authorized body shall mean a state body which carries out guidance in the area of electric power industry;
27) national electric power grid – a totality of substations, distribution installations, inter-regional and (or) interstate electric power transmission lines and electric power transmission lines which carry out the supply of electric power of electric stations with voltage of 220 kV and more, which are not be subject to privatization and which are be transferred to a national company in accordance with the procedure and on conditions to be defined by the Government of the Republic of Kazakhstan;
